horseracing disputes go to HISA arbitration

Horseracing Integrity and Safety Authority (HISA) has selected Drug Free Sport International (DFS) to build an independent Anti-Doping and Medication Control (ADMC) enforcement agency known as the Horseracing Integrity and Welfare Unit (HIWU). Disputes related to HIWU’s Equine Anti-Doping or Controlled Medication Rule Violations must follow arbitration procedures outlined in the Rule 7000 Series as of January 1, 2023.

If an individual is charged with both an Equine Anti-Doping (EAD) Violation and another violation, the procedures for EAD Violations apply.

Don't Be Confused About the Arbitration Timeline for Equine Anti-Doping (EAD) Violations

EAD Violations are heard by an independent Arbitral Body. Hearings regarding EAD Violations take place in person unless the arbitrator orders the hearing to take place via an audio-visual teleconferencing system.

Here’s a general timeline of what to expect from the process:

  1. The Agency initiates proceedings with the Arbitral Body.
  2. Prehearing submissions including the evidence to be relied on at the hearing are filed within 14 days of the request for a hearing.
  3. The hearing takes place no more than 60 days from the date the last Covered Person requested a hearing in a particular case.
  4. A final decision is issued on or before 14 days after the close of the hearing.

ECM and/or Other Violations are determined by an Internal Adjudication Panel (IAP). Hearings take place by use of an audio-visual teleconferencing system unless members of the panel request an in-person hearing.

  1. The Agency initiates proceedings with the IAP.
  2. Prehearing submissions, including the evidence to be relied on at the hearing, are filed within 14 days of the request for a hearing.
  3. The IAP either holds the hearing or determines the matter based on the written submissions. (The IAP has broad discretion to determine the conduct of proceedings based on the specifics of the violation).
  4. The IAP issues the final decision on or before 14 days after the last written submission or the close of the hearing.
